Three elements must be present for one to get compensation for damages suffered by the negligence of another: liability, damages, and a source of payment.  The first element is proof of wrongdoing on the part of the defendant.  The second element requires that one prove all damages caused by the negligent party.  Only damages caused directly by the negligent actions are compensable.  The third element requires that the one sued have sufficient means by which to pay the judgment or settlement in the case.  This is usually accomplished through insurance.

Even though the majority of all personal injury cases are resolved prior to trial, this end is only achieved after much preparation and research. All cases should be prepared as if they are going to trial. The attorney must be a litigator to enhance the settlement value.
